The judge makes the decision based on the evidence; the judge maintains their objectivity, and if the accused is found innocent, the accused is freed. It wouldn't make much sense for all citizens to be treated equally before the law, regardless of their class, caste, gender, religion, or philosophy, if the Constitution did not guarantee every person a fair trial.
