Article 39A of the Constitution guarantees a fair trial to every citizen.
The Constitution of India provides for the rights of the accused as
1)      Article 22: It provides for the right of the accused to be informed of the offense at the time of the arrest. He is further guaranteed that while in custody, the police cannot torture him or punish him. It is the duty of the judge to decide whether the accused is guilty or not.
2)      Article 39A: It provides for the provision that every citizen has the right to free legal aid irrespective of poverty or any disability. In case the accused is not able to hire a defense lawyer, it is the duty of the state to provide him with the opportunity of free legal aid.
