A political party is recognised as a state party when, besides other things, it wins at least two seats in the Legislative Assembly.
Political parties, based on their area of influence and extent, can be recognised as a national party or regional/state party. The conditions to be recognised as a state party in India are as follows:
1)      The party must secure at least 6 per cent of the total votes polled in the elections to the Legislative Assembly, and in addition, it must win at least two seats in the Legislative Assembly; or
2)      The party must secure at least 6 per cent of total votes polled in Legislative Assembly elections, and in addition, it must win one seat in the Lok Sabha; or
3)      The party must win at least 3 per cent of the seats or at least three seats, whichever is more, in the elections of the Assembly; or
4)      The party must win 1 out of every 25 seats from a state in the general elections of the Lok Sabha, or
5)      The party must secure at least 8 per cent of the total votes polled in an Assembly election or elections of the Lok Sabha.
