A Supreme Court or High Court judge can only be removed from power if two-thirds of the members of both Houses of Parliament separately pass an impeachment motion. Once someone gets selected as a judge to the Supreme Court or the High Court, removing them from that position is nearly impossible- it is as impossible as removing the Indian President. The judiciary is not under the control of the legislature or the executive. The senior judge of the Supreme Court usually becomes the Chief Justice. The President selects the Supreme Court and High Courts judges in consultation with the Prime Minister and the Chief Justice of India. Such procedures leave almost no gap for the political executive’s interference.
