According to Article 22 of the Constitution, every person has a Fundamental Right to protection against arrest.
The constitution of India guarantees every citizen certain fundamental rights against the state. Similarly, Article 22 of the constitution of India provides for the fundamental right of every arrested person. According to its provision, the accused person has the right to be informed at the time of the arrest of the offence. He has the right to be presented before the magistrate within 24 hours of his arrest and not to be tortured or treated ill within the custody. It is the court that is obliged to decide whether the accused is guilty or not. If found guilty, he is sentenced to the punishment. And if not, he is set free of the offence.
