Confessions made during police custody cannot be used as evidence. As long as a person is in the custody of the police, the statement given by him cannot be considered evidence. This thing is written in section 26 of the Indian Evidence Act. The Indian Evidence Act is designed so that the police do not misuse their powers and the police do not make the accused confess guilt by torturing him, pressurizing him, or beating him because, by torture, even the most innocent confess the crime which they do not commit. Tourtour or pressurizing may lead to a wrong confession and a wrong decision which can harm the dignity of the judiciary.
