A fair trial is conducted in an open court in public view. It is held in the presence of the judge, the defence lawyer, and the prosecution lawyer. The judge has to decide the case given the available witnesses and the evidence. The defence lawyer presents the witnesses and the evidence in favor of the accused and cross-examines the evidence of the prosecution. The prosecution provides the witnesses and the evidence against the accused. The judge then decides the matter. If found guilty, he can give punishment accordingly. If found innocent, the accused is acquitted of the offence, as mentioned in Article 21 of the constitution of India.
