The Supreme Court resolved the Subhash Kumar vs State of Bihar case in 1991. Subhash Kumar, a resident of Bihar, filed a PIL against two iron and steel companies stating that they were polluting the water of the Bokaro river by deliberately throwing toxic waste materials and chemicals into the river. Also, it stated that the state pollution control board was not taking any action against the companies and, thus, failed to prevent this massive water pollution. The Supreme Court stated that the Right to Life under Article 21 of the Indian Constitution also implies the right to live in pollution-free air and water. Thus, it is the government's duty to ensure that this Fundamental Right of the citizen is not violated by factories, companies, or any other individual.
