When a person is kept in illegal custody it is called detention. The constitution of India lays down certain rights in order to protect the rights of the accused or detained so that there is no violation of fundamental rights. The rights include, that the accused person who is arrested has to be informed about the reasons for arrest, he/she has to be presented before the magistrate within 24 hours of arrest, the accused cannot be tortured or ill-treated by police authorities, the confessions made by an arrested person in police custody cannot be used as evidence in the court.
