As per the DoPT Schedule, sons/daughters of the following are excluded from OBC reservation (i.e., deemed “creamy layer”):

(1) Constitutional post holders (President/Vice-President, SC/HC Judges, CEC, CAG, UPSC/State PSC Members, etc.);

(2) Group A/Class I officers of Central/State/All-India Services (either/both parents), with specified conditions for Group B/Class II;

(3) Those where either parent had certain senior international postings (UN/IMF/World Bank etc.) for 5+ years, under defined clauses;

(4) Families crossing the Income/Wealth tests—note the explanation that income from salaries and agricultural land is not counted in the income test;

(5) Specified high-status professional/business categories as elaborated in the Schedule and subsequent clarifications/equivalence circulars (including PSUs).
