Subjects like computer software are on the residuary list. There are three lists in the Indian Constitution. These are the Union List, the State List, and the Concurrent List. The union list includes issues on which only the Centre can pass legislation. The Union list has 97 subjects, including matters of defence, foreign affairs, banking, corporation tax, etc. According to the state list, state governments have the authority to create laws. The subjects include public order, local government, agriculture, fisheries, gas, allied works, etc. The Concurrent List consists of 52 issues for which both the Parliament and the State Legislatures are responsible for making laws. Some items on this list are criminal law and procedure, marriage and divorce, transfer of property, etc. Some subjects have come up after the constitution was drafted due to changes in technology and society. Such subjects are known as ‘residuary subjects. The Centre makes laws on these matters. Residuary subjects include computer software, which does not fall into the above three categories.
