Article 39 A places a duty upon the State to provide a lawyer to the accused if he is not able to engage one himself (due to poverty or some other disability).
Article 39A of the Constitution of India provides for equal justice and free legal aid to every citizen. It grants free legal aid to the poor and provides for equal opportunity to seek justice. In this context, a defence lawyer can be provided to the accused if he is unable to hire one. The defence lawyer, on behalf of the accused, provides witnesses and evidence in court for a free and fair trial. It is the fundamental right of every citizen to be defended by a lawyer which can be enjoyed by every citizen irrespective of poverty or some other disability.
