The Fundamental Right to Constitutional Remedies was considered the “Soul of the Constitution” by Dr B.R. Ambedkar, the head of the Drafting Committee of the Constituent Assembly, the body which prepared the constitution of India. It is provided in Article 32 of the Indian Constitution in its part III, along with all the other Fundamental Rights mentioned in Articles 12 to 35. It is the guarantee of fundamental rights and provides the citizens of India with the authority and power to move the courts (High courts and the Supreme Court) in case of breach of their fundamental rights. They can do so by filing writs. This is the reason why Ambedkar considered it the Soul of the Constitution.
