Adoption falls on the Concurrent List. India has a federal form of government. The Indian Constitution has listed the subjects on which the Union and State governments can make laws. These lists are divided into Union, State, and Concurrent. This is done so that the legislative powers of both levels of government are specified to avoid any conflict. The Concurrent List consists of subjects on which both the Central Government and the State Governments can legislate as they are of national importance. Still, a uniform policy on the same is not necessary as states may have their unique requirements. Some of these subjects are adoption, trade unions, etc. In case of any conflict between the laws of a state government and the central government, the law of the latter prevails.
