According to the Constitution of India, no one can be deprived of his life or personal liberty except by following legal procedures. It also means that unless a government or police officer has a valid legal cause, they cannot arrest or detain any citizen. However, even if they do, they must follow certain procedures:

A person arrested and detained in custody must be notified of the reasons for their arrest and imprisonment.

A person who is arrested and detained must be brought before the nearest magistrate within 24 hours of their arrest with their lawyer for the defence.
