Detailed Solution

A police officer cannot detain any person without a proper legal justification. This would be considered a breach of their rights. The Constitution of India provides Fundamental Rights to its citizens, which ensure a fair and dignified life for them. The Right to Freedom (Articles 19 - 22) implies an absence of restraints imposed by individuals or the Government. An individual's right to personal liberty ensures that until and unless there is a proper legal justification and a warrant, they cannot be detained or arrested by the police or the Government. Anyone who is to be charged should be informed of the reasons for the arrest. Moreover, they should be presented in front of the District Magistrate within 24 hours after an arrest. The detained person has the right to consult a lawyer in his defence.
