Yes. Under Indian law (Maternity Benefit Act), women are entitled to full salary during maternity leave, calculated based on average wages over the preceding three months.
For the first and second child, employees are entitled to 26 weeks (about 6 months) of paid leave. For the third child onwards, the leave is 12 weeks (around 3 months).
Request it in writing to your supervisor or HR, with clear mention of the leave dates and include medical documentation. This should be done ahead of time—ideally several weeks before the due date- to ensure proper planning.
Employees can begin leave 8 weeks before the expected delivery date (for the first and second child). For the third child, maternity leave usually starts 6 weeks before delivery.
The Maternity Benefit (Amendment) Act, 2017 expanded paid maternity leave to 26 weeks and introduced benefits for adoptive and commissioning mothers, as well as mandatory crèche facilities and work-from-home options post-leave.
Extensions beyond the statutory period are not guaranteed. Some employers may offer unpaid leave based on company policy and with appropriate medical justification.
