Recognition of Physiotherapists – The Rehabilitation Council of India Act, 1994

The Rehabilitation Council of India Act, 1994, governs the training of rehabilitation professionals and maintains a Central Rehabilitation Register. A “physiotherapist” is a recognized rehabilitation professional in India. Only individuals with a recognized qualification and registration with the RCI can practice as physiotherapists in India. This act ensures that physiotherapists adhere to RCI regulations.

According to this act, Physiotherapists cannot practice medicine or prescribe drugs without the required qualifications. They cannot claim to be specialist medical practitioners or use the prefix “Dr” in their prescriptions, as ruled by the Hon’ble Supreme Court.

Can a Physiotherapist be Called a Medical Doctor – Supreme Court’s Verdict

The Supreme Court of India has clearly stated that a Physiotherapist cannot call themselves a doctor. India recognizes three major systems of medicine: Allopathic, Ayurvedic, and Homeopathy. Only practitioners of these recognized systems can use the title “Doctor.” Physiotherapists are not allowed to portray themselves as registered medical practitioners by using the prefix “Dr.”

Under the Indian Medical Council Act, 1956, the Supreme Court ruled that Section 15(2)(b) of the act prohibits anyone from practicing modern scientific medicine without being enrolled in a State Medical Register. There are two types of registration: provisional registration for training and registration under Section 15(1). The “Indian Medical Register,” maintained by the State Medical Council, requires a recognized medical qualification.

The court noted that a person registered in a State Medical Register cannot be enrolled in the Indian Medical Register without a recognized medical qualification. This verdict ensures that each system does not allow crosspathy, meaning one can only practice in the system they are qualified in. Practicing outside this system without the required knowledge is considered fraud.
