    The Tenure and Appointment of the CAG

    The Comptroller and Auditor General of India are appointed by the President of India, on the recommendation of the Prime Minister, for a term of six years. The CAG may be reappointed for a further term of six years.

    • The CAG is not a civil servant and is not a member of the Indian Administrative Service (IAS).
    • The CAG is not subject to the direction or control of any other authority in performing his duties.
    • The CAG may be removed from office by the President, on the recommendation of the Prime Minister, for reasons of misbehavior or incapacity.

    The Powers and Duties Delegated to the CAG

    The Constitution of India vests the Comptroller and Auditor General (CAG) to audit the accounts of the Union and the States. The CAG is also responsible for examining the public sector undertakings’ economy, efficiency, and effectiveness. The CAG is also responsible for submitting reports to the Parliament on the performance of these institutions.

    Constitutional Provisions Regarding CAG

    The Constitution of India has not specifically provided for the office of the Comptroller and Auditor General of India. However, the Constitution has empowered the Parliament of India to make laws regarding the organization, functions, and powers of the CAG. The Parliament has exercised this power by enacting the Comptroller and Auditor General’s (Duties, Powers and Conditions of Service) Act, 1971. This Act provides for the organization, functions, and powers of the CAG and specifies the duties, powers, and conditions of service of the CAG.
